Walton County - Probate Court - Homestead Exemptions
Scope and Contents
This series contains homestead exemption records of the Court of Ordinary, now Probate Court, of Walton County. Also called statutory or "short" homestead exemptions, these records show the property exempted from levy or sale of a debtor's personal property under Section 2040 and 2013 of the Code of Georgia, Act of 1822. The code stated that certain property of every debtor, who was head of a family, would be exempted from levy and sale by virtue of any process whatsoever. This property included (1) fifty acres of land, (2) one horse or mule, (3) one cow and calf, (4) ten head of swine, (5) $50 worth of provisions, (6) beds and bedding sufficient for family use, (7) tables and chairs sufficient for family use, (8) equipment and arms for a military man, (9) ordinary cooking utensils, (10) a family Bible and religious works, (11) family portraits and a (12) sewing machine. The petition to the Ordinary also gave the debtor's occupation and the size of his family.
