Scope and Contents
This series consists of a single small volume of the cases made against the State of Georgia (Lessor) by the Western & Atlantic Railroad Company (Lessee) along with the findings and judgments of the Western & Atlantic Railroad Commission concerning the following three basic claims: (1) That the State of Georgia owes the Western & Atlantic Railroad Company for the betterments the Company made to the real estate and machinery of the railroad and that the Western & Atlantic Railroad Company has the right to remove such betterments upon expiration of the lease in 1890; (2) That the State of Georgia owes the Western & Atlantic Railroad Company for taxes the Company paid the State of Tennessee beginning in 1879 and continuing to 1890; and (3) That the Western & Atlantic Railroad Company has the right to return all real estate and machinery to the State of Georgia in the same state of condition as it was received from the State in 1870. The Commission, made up of eight Georgia citizens, was created by a Resolution of the General Assembly on December 22, 1890, and resolved that claims No. 1 and 2 of the above stated, were to be disallowed. Claim No. 2 was made against the State which was ordered to pay the Western & Atlantic Railroad for the taxes it paid to the State of Tennessee minus any interest. The volume is 67 pages in length and takes the entire matter through in strictly legal fashion.
